Building development within 'bushfire prone areas' in NSW is controlled by the legislative requirements of the Rural Fires Act,1997 and the Environmental Planning and Assessment Act,1979. In addition the provisions of the Building Code of Australia, AS 3959 - 1999 Construction of buildings in bushfire-prone areas, Planning for Bushfire Protection, 2006 are utilised to ensure that development within areas at risk of an attack from bushfire are designed and constructed to minimise the impact on the building and enhance the safety of occupants and fire fighting personnel.
